MyConnectivity G.I.E., a Groupement d’Intérêt Économique incorporated under the laws of the Grand Duchy of Luxembourg and registered with the Luxembourg Trade and Companies Register under number C166, having its registered office at 9 rue du Laboratoire, L – 1911 Luxembourg, Grand Duchy of Luxembourg (“MyConnectivity” or “we”) provides various websites, including “myconnectivity.lu” (hereinafter collectively the “Websites”). 

Any person making use of the information and content offered by the Websites is deemed to have read and accepted all of the provisions of these Terms and Conditions of Use (“TCU“). The TCU also apply to the MyConnectivity pages on social networks, in addition to the specific conditions of use applicable to these sites. 

Intellectual Property Rights” refers to, without limitation, all copyright and related rights (including moral and proprietary rights), trademarks (registered or unregistered), service marks, design rights (registered or unregistered), brand names, logos, slogans, trade names, company names and reputation, domain names, database rights, rights to confidential and/or proprietary information and all other intellectual property rights, as well as all similar or equivalent rights or forms of protection in any part of the world.

“Applicable Laws” means all laws, regulations, and other requirements applicable in the Grand Duchy of Luxembourg, as amended.

“Social Networks” refers to all social networks used by MyConnectivity (including Facebook, Linkedin, Instagram and YouTube).

“Users” or “You” refers to any user of the Websites or MyConnectivity’s Social Networks.

2.1 The purpose of these TCU is to set out the Website Terms and Conditions of Use and to govern the relationship between MyConnectivity and Users.

2.2 MyConnectivity provides the Websites free of charge in order to accelerate and improve connectivity for private households and businesses in the Grand Duchy of Luxembourg.

3.1 Users agree to use the Websites in accordance with the applicable laws and within the conditions and limits described in these TCU.

3.2 Access to the Websites is via the Internet. Users declare that they are aware of the risks associated with the use of the Internet and accepts them. Users must protect themselves against the effects of computer piracy by adopting an appropriate and secure computer set-up.

4.1 The Websites, all their elements (including the layout) and the information are protected by intellectual property and copyright laws.

4.2 MyConnectivity is the owner of the Websites (architecture, texts, titles, photographs, images, illustrations, logo, etc.) and of all related Intellectual Property Rights. Unless otherwise indicated, MyConnectivity does not grant any licence or authorization relative to the Intellectual Property Rights that it has on the Websites as well as its constituent elements.

4.3 The User must not take any action likely to infringe, misappropriate, violate, jeopardise, or compromise these Intellectual Property Rights, or the Intellectual Property Rights of third parties, or the legality and/or enforceability of these rights.

4.4 The User shall promptly notify MyConnectivity in writing of any threat, warning or notice of claim or action adverse to My Connectivity’s Intellectual Property Rights.

4.5 Any modification, transformation, or adaptation, whether total or partial, of the Websites or of the aforementioned types of content is forbidden.

4.6 Unless expressly authorised by MyConnectivity and the publisher, the Websites may not be integrated or reproduced in any way, in whole or in part, in another portal or Internet site.

5.1 MyConnectivity reserves the right to change, modify or suspend, without prior notice, the Websites for maintenance, updating or any other reason deemed necessary.

5.2 In particular, MyConnectivity may at any time withdraw, add, complete or specify all or part of the information and services contained or offered on the Websites. MyConnectivity shall not be held liable for any direct or indirect damage resulting from such modifications.

6.1 To the extent permitted by Applicable Laws, MyConnectivity shall not be liable for any special, incidental, direct or indirect, punitive or consequential damages, or for any loss of data, opportunity, reputation, profits or revenues in connection with the Websites.

6.2 MyConnectivity will do its utmost to ensure maximum availability of the Websites. However, MyConnectivity shall not be held liable in case of momentary or total unavailability of the Websites, in particular, but without limitation, in case of malfunction of the User’s equipment, security breach, errors or fraud committed by the User or third parties, malfunction of the Internet network, maintenance operations, etc. MyConnectivity shall not be held liable in case of malfunction of the User’s equipment or third parties.

6.3 MyConnectivity will do its utmost to ensure the security of the computer system. However, MyConnectivity shall not be held liable in the event of an attack on the computer system or of the temporary or total unavailability of the Websites.

6.4 MyConnectivity will do its utmost to ensure the accuracy of the information contained on the Websites and published on its social networks. However, MyConnectivity cannot be held responsible for any omission to update information or forms, for system manipulation or encoding errors, for inaccuracies, for gaps in the information provided or for any errors. My Connectivity’s objective is to provide accurate and up-to-date information from a variety of sources, but MyConnectivity cannot avoid all risk of material error. None of the information published on the Websites is intended to be exhaustive or to constitute a commitment on the part of MyConnectivity. The information on this Website is of a general nature. The information is not adapted to personal or specific circumstances and therefore cannot be considered as personal, professional, or legal advice to the User. If the User requires personal or specific advice, they should always consult the relevant departments within the various administrations.

For the convenience of Users, these Websites may contain links to other sites that may be useful or of interest to them. MyConnectivity does not systematically control the content of these third-party sites. Therefore, MyConnectivity cannot be held responsible for the content of these sites, either in terms of their legality or the accuracy of the information contained therein.

These TCU may be amended or supplemented at any time, without prior notice, in line with changes made to the Websites, changes in legislation or for any other reason deemed necessary and legitimate. It is the User’s responsibility to keep abreast of the TCU, of which only the updated version accessible online is deemed to be in force. It is possible that between two visits to the Websites, the TCU may be modified and it is therefore the User’s responsibility to read them carefully before each new visit. In the event of substantial modifications, MyConnectivity will inform Users in advance by e-mail or by publishing a notice on the Websites.

In the event of any discrepancy between the French and English versions of the TCU, the French version shall prevail.

9.1 These TCU shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg.

9.2 Any dispute relating to the use of the Websites or to these TCU shall be governed by Luxembourg law and shall fall within the exclusive jurisdiction of the courts of Luxembourg City, Grand Duchy of Luxembourg.

10.1 Personal data provided by the User is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the Privacy Policy.

11.1 Any User who joins the MyConnectivity community on the Social Networks undertakes not to use the latter:

11.1.1 to engage in, promote or encourage illegal activities; 

11.1.2 to violate or encourage the violation of the legal rights, including the Intellectual Property Rights, of MyConnectivity or third parties;

11.1.3 intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes or other items of a destructive or deceptive nature;

11.1.4 for illegal, invasive, counterfeit, defamatory or fraudulent purposes.

11.2 In particular, all Users must refrain from any form of discrimination related to race, colour, religion, gender, sexual orientation, age, national origin, disability, marital status or professional status. Abusive, racist, sexist, or offensive comments also have no place on social networks. The Social Networks Terms and Conditions used by MyConnectivity also apply to their use.

11.3 MyConnectivity performs a posteriori moderation of information or contributions published on our social networks. The User understands and acknowledges that MyConnectivity may, on its own initiative or upon notification by another User, delete any content that violates these Terms and Conditions or applicable Laws, without justification and/or prior notice. MyConnectivity also reserves all remedies available under the Terms and Conditions of the Social Networks concerned and/or any other legal action at its disposal. 

11.4 At any time, Users may report any inappropriate or illegal conduct on the Websites or Social Networks to MyConnectivity, including fraud, scams and bad business practices, by writing to info@myconnectivity.lu.

11.5 Comments on the Social Networks will be answered from Monday to Friday during office hours. Administration of the pages is not guaranteed on a continuous basis outside of these hours, as well as at the weekend or on public holidays.
